Back Market has chosen to collaborate with the artist, Gab Bois (hereinafter the “Artist”) for her skill in creatively reusing everyday objects. Her work reflects the values of Back Market, particularly its dedication to sustainability and innovation. This partnership seeks to unite their shared vision, fostering a collaboration that will engage and inspire Back Market's audience. Together, they partnered for the production of pieces of the Artist’s artwork (hereinafter “Artworks”).
To facilitate the sale of the Artworks, Back Market and Gab Bois have engaged external contractors to manage sales through a dedicated website powered by Shopify, available in France and the United States (hereinafter “Website”) and to handle delivery to you, as customers (hereinafter “You or you”). They have selected the Right to Repair coalition (Repair.org as the seller of the Artwork “Seller” and iFixit in charge of delivering you the Artwork).
The purpose of these general terms of service (the “Terms of Service”) is to define the rules applicable to access the website and buy the products offered on the Website.

The Artworks
The Artist created 6 exclusive Artworks as part of the Back Market x Gab Bois F/W 2005: Hardwear collection that you can find on the Website.

How to order the Artwork ?
It’s very easy for you to order an Artwork:

Select the Artwork you wish to purchase, click “buy”, and provide the required information when prompted (desired delivery, address, payment method, etc…);

The amount of tax and service fees appear in the final basket before you confirm the payment, depending on your location.
Once the order has been validated, a summary of the order will be sent to you by email. The order is deemed to have been accepted on receipt of this confirmation email.
The Seller reserves the right to refuse any order for legal or technical reasons, such as payment problems, or if the Artwork is out of stock.

Delivery
The Artworks presented for sale on the Website can only be shipped to the 48 contiguous states of the United States and France. They are delivered at the delivery address indicated when ordering. The risk of loss or damage passes to you upon delivery. If you have opted for a tracked delivery method, you may track the delivery of the ordered Artwork(s) directly on the Website.
You will be informed of the delivery date after you have selected a shipping method.
Unless otherwise mentioned when ordering, shipping fees are charged. The shipping fees are communicated to you prior to any payment.
In the event that Artworks are damaged in transit (damaged or opened package / missing or damaged Artworks), you shall make all possible reservations upon delivery of the Artworks. You also need to file a complaint within 3 business days via the Website one Product has been received.

How do I pay on the Website?
The prices of the Artworks are indicated in euros (€) for customers in France and in dollars (USD) for customers in the United States. Prices include all applicable taxes (VAT for sales in France) at the time of purchase, unless otherwise indicated.
Delivery charges are added to the total amount of the order and are specified during the payment process. The Seller reserves the right to change prices at any time, but the prices in force at the time of the order will be applied.
The payment methods on the Website are specified on the Website (for instance, payment in installments, Paypal, credit card). Payment are made to Repair.org who will donate sales proceeds to the Right of Repair coalition in the United States and in Europe, in accordance with applicable laws and regulations.

Can I change my mind?
Due to the particular nature of the Artworks offered for sale on this Website, i.e. works of art, no right of withdrawal may be granted. All orders are therefore final and may not be returned or reimbursed, except in the event of non-conformity of the product or a proven defect, in accordance with the conditions laid down by law.

Warranties
You benefit from a legal warranty of conformity which intends to guarantee that the Artwork corresponds to the description given at the time of purchase on the Website (authenticity, characteristics, etc.).
This warranty may cover problems such as misrepresentation of the Artwork's authenticity, or non-conformity with the conditions of sale (dimensions, condition, technique used, etc.).

Applicable law and dispute resolution
These Terms of Service and any action related thereto will be governed and interpreted by and under the laws of the State of New York, consistent with the Federal Arbitration Act, without giving effect to any principles that provide for the application of the law of another jurisdiction.
Users may report complaints related to the Website by filing the form available under this link, or to the Division of Consumer Protection of the State of New York. In case of an issue with any Artwork(s), you may report complaints to the Seller, or the Division of Consumer Protection of the State of New York.
